Terms of Service

Please read these terms carefully before using our website or engaging our services. By accessing or ordering from Sculpt, you agree to be bound by these terms.

1. Acceptance of Terms

By visiting sculptdesigns.co.za or requesting our services, you ("Client") agree to these Terms of Service. If you do not agree, please do not use our site or place any orders.

2. Services

We provide custom software solutions including:

  • Website design and development
  • Mobile and web application development
  • UI/UX design
  • Ongoing maintenance and support

3. Proposals & Quotes

All project proposals and quotes are valid for 30 days. Any changes in scope may result in updated timelines and fees. Work begins upon written acceptance of the proposal and receipt of any required deposit.

4. Payment Terms

  • Deposits: A non-refundable deposit (typically 30%) is required to start work.
  • Milestone Payments: Remaining fees are due as outlined in the proposal.
  • Late Payments: Unpaid balances past due will incur a 5% late fee per month.

5. Client Responsibilities

  • Provide clear requirements, assets, and feedback on schedule.
  • Ensure you have legal rights to any materials supplied.
  • Maintain backups of any content you supply.

6. Intellectual Property

Upon full payment, Sculpt grants the Client a non-exclusive license to use the final deliverables. We retain the right to showcase the work in our portfolio and marketing materials.

7. Confidentiality

Both parties agree to keep confidential any proprietary information exchanged in the course of the project, unless required by law.

8. Warranties & Disclaimers

We warrant that our services will conform to the agreed specifications. However, we cannot guarantee uninterrupted operation. All services are provided "as is" and "as available" without other warranties.

9. Limitation of Liability

In no event shall Sculpt's liability exceed the total fees paid by the Client for the specific project. We are not liable for any indirect, incidental, or consequential damages.

10. Termination

Either party may terminate with 14 days' written notice. Upon termination, the Client pays for work completed up to the termination date, and we deliver any completed files.

11. Governing Law

These terms are governed by the laws of South Africa. Any dispute arising under or in connection with these terms will be resolved exclusively in the Western Cape Division of the High Court, sitting in Cape Town.

12. Changes to Terms

We may update these Terms of Service at any time. The "Last Updated" date will reflect any changes. Continued use after updates constitutes acceptance.
